The way DMCA is supposed to work:
1) Web host receives notice The DMCA was created to remove liability from common carriers (hosting companies, telcos, etc.) So if you receive a DMCA notice, you either have to comply or formally respond in writing to the host that you own the copyright / have paid the license fees etc. to the material. Most people don’t respond in writing, because it creates a larger liability for them if they are lying about owning the copyright or having properly licensed the material. Either way, this removes the liability from the hosting company because they are acting as a mediator of sorts. Of course, you are not likely to get the same response that Time Warner does, since the abuse guy at your hosting company will have a hard time judging whether you wrote the blog article first or the other guy did.
